Power of Attorney
What if you became too ill to make your own decisions, who would make those decisions for you?
If you wish for a loved one or someone you trust to act as your Attorney to make decisions on your behalf, whether in relation to financial/property matters, i.e. paying your bills, selling your home, your own welfare, i.e. choosing where you live, or both, then you can sign and register a Power of Attorney document.
There are three styles of Power of Attorney:-
1. A Continuing Power of Attorney, which deals with property and financial matters
2. A Welfare Power of Attorney, which deals with your own welfare
3. A Continuing and Welfare Power of Attorney, which deals with both property/financial matters and your welfare
You can appoint one or more persons to act as your attorney. A continuing attorney can exercise their powers immediately or your can specify that their powers take effect at a later date when you have lost the capacity to make your own decisions. A welfare attorney cannot be exercised until such time as you have lost the capacity to make your own decisions. It should be noted that a person who is currently declared as a bankrupt, cannot be appointed or act as a continuing attorney.
We can assist you to prepare the relevant written document, certificate of capacity and registration form. We can arrange for all parties to sign the relevant documents and then arrange to register the documents with the Office of Public Guardian (Scotland).
